The UK Treasury has determined that coin staking cannot be classified as a collective investment.
This decision was made alongside a financial law amendment and specifies that the act of staking virtual assets for proof-of-stake blockchains like Ethereum and Solana does not fall under the category of collective investment.
This differs from the stance of the US Securities and Exchange Commission (SEC), which considers staking as a form of collective investment and has imposed penalties on exchanges offering staking services.
The UK’s recognition of staking as a blockchain verification process has led to speculation on whether the United States will also adopt this approach. The SEC’s actions, based on the pooling of investors’ assets, have resulted in fines and required strict financial reporting and compliance.
