Attorney Jeremy Hogan has laid out the potential avenues for the ongoing lawsuit between the Securities and Exchange Commission (SEC) and Ripple, predicting that it could potentially continue until 2027.
Hogan notes that the SEC has limited options for reaching a final judgment in the case.
In July 2023, a court in the Southern District of New York ruled that programmatic sales and token distributions do not qualify as the offer and sale of securities.
The SEC then filed an appeal, which was ultimately rejected by the judge. Based on this timeline, Hogan believes there is a 39.5% chance that the SEC will continue proceedings against the individual defendants in April 2024.
If an appeal decision is reached in 2026, the case would then be returned to Judge Analisa Torres for further consideration.
